Discrimination Laws: How to Protect Yourself

Here all this time I thought that ADA laws and their tenets had infiltrated business practices everywhere. That was until yesterday when I had a conversation that shocked me. I was told that an HR Director resigned because she was being asked by the owner of the company to fire an employee over the phone who was out on maternity leave. The Director thought that doing so was not such a good idea and left to avoid being in the wake of that call which she anticipated would most certainly bring with it a law suit. So what did the boss do? He had is wife call the new mom to let her go. Apparently, there was also another termination at about the same time of a pregnant woman which will not bode well for the company if either woman takes the employer to court.    

Here’s why…

Anyone terminated who falls into a protected class can claim that they were discriminated against whether it’s true or not. So it’s worth doing your homework  in advance to be sure you avoid any appearance of bias and are ready to defend your decisions as solely based on business reasons.
